update goin to court

okay i talked to the shop today about my car and they said that the only way they would work on it again or guarentee the work is if i paid for a new rear end from jasper....they said jasper will come and get it and since i have a brand new carrier and ring and pinion all it would cost is 1500...he was tryin to act like i was getting a deal when he told me that he said the new ones from them were 1800.. yeah they r if u get everything from them. i asked why they didnt see the axles bowed at the beggining when they replaced the wheel bearing and he said its cause they werent looking for it. well i pointed out to him on the reciept it says when diagnosing problems they will make a list of all the stuff thats wrong w/ it and i checked and warped axles arent on there. he said it would be best to spend the 1500 on a new rear then to get the axles cause the axle shafts could be bent yeah right i just spent almost 2000 on the rear when they got it...guess im goin to court now. oh and he tried to say that as i was leaving i called him an mother fucker and peeled out all the way out the drive way. but funny thing they didnt know my mom was in the lot waiting to follow me back and she witnessed i didnt. he says the techs saw me and heard me do it and i told him i would of said it to his face and he said if i said it and wanted to to come back and do so. i just think he was trying to get me arrested for commin back to start shit so i just told him i didnt say it and didnt care if he belived it or not and that im not intimidated by him cause he wears a muscle shirt and drives a bike.

Well, just take him to court don't let him sucker you into having to play the bongo's on his testicles. Good luck

wow, you sure picked a classy place. first off, it would take a serious impact from outside the rear axle to bend the axle tubes, and for both to be bent, well sufice it to say hes full of shit. your rear axle housing is fine. IF the axles are bent (which i really dont think they are) they sure as shit should have caught that. IF they are rusty (again very suspect seeing as they are bathed in gear oil) they should have spotted that, the fact is they didnt do the install correctly and at every point they have tried to rip you off even more, and now that you ahve their balls in a bear trap by taking them to court they are trying to get you to ruin your credibility by making up lies about your behavior. I commend you for keeping your cool, and you are doing the right thing by taking him to court. best of luck with how it turns out.

Just always act calmly and never talk out of turn, it always pisses the judge off, well so far as to what i've seen on court tv shows.

have you gotten a second opinion from someone else as to what's wrong with it. if you can get a mechanic that can back you up that would be huge for your case

this is a real coincidence cause i was a juror on a case like this and the guy didn't have anyone qualified to back him up, all he had was his buddy who was like a "yea i'm no mechanic but it definatley wasn't doing that before". that's no good, you need someone qualified to back you up, just add his bill to what your sueing for, along with a list of all the stuff they charged you with + a little extra for the inconvience

yeah i gotta go fill out the paper work to get in line w/ a court date tomorrow i hope i dont have to say how much im suing for right then cause i still gotta go and get some estimates and see whats actually wrong and get some statements wrote up...i think i will go for the cost of one of those jasper rear ends since thats what they say will be the only fix (they dont know im takin it to court they thought they were gonna get me for even more but i showed up and said no my cars goin home w/ me) and the labor for what they have charged and the labor it will cost to intall a new rear. also for the insurance it cost me in their shop and the parts and labor to get my brakes fixed again since theyve messed something up...hopefully i can sue for the known amounts then say somethin along the lines of having them pay to get it fixed right by the dealership and of course a lil extra for that fraud on the reciepts they commited....oh and u guys dont know how hard it was not to blow up especially after he called and told my dad all that shit i supposedly did (him not knowing my mom was less than 15 feet away) he and myself are both lucky ive calmed down alot these last couple of years (im only 20) other wise he would of had a sore jaw and i woulda been in jail after all the shit he pulled. oh and sorry for some of the language mods but some of it i feel is nessesary to fully represent their stupidity!!

Oh dude I know exactly how it is. I myself have a minor anger control problem... back when I was in highschool the security guard was always forgetting to unlock the gate... so after school I broke one of the windows on her car with a rock. This was 12th grade... I blamed it on a kid who picked on me in 9th grade, who just so happened to have a record. Two birds with one stone. I would leave that out.. most judges on small claims dont want to hear about $hit like that.. if you do that, it will sound like your just tryin to soak as much out of them as you can and you could loose the judges favor..

Go to court with estimates to show Exactly how much it has/will cost you out of pocket to have your car fixed properly.. Only facts on paper.. estimates, time lost from work, etc.. no little extra's..

judge will take you more seriously and it might help u out

well i called and found out today that i need to take it to civil court not small claims the cap on that is 1500 and i paid more than that already for what they have done. so im gonna call around for some lawyers mon. i guess i swear im only 20 and feel like i could have a heart attack at any time it seems like this year its been one thing after another between jobs, bills, and my car im loosing my mind ill have grey hair in a year if this keeps up...lol just breath!!
