i got arrested!

and not even for street racing or speeding! here's the story...

so since there isn't shit to do in this town me and everyone else i hang out with are usually in the taco bell parking lot...never cause any toruble or harrass anyone. so about 4 nights ago we were all sitting there and a cop came in, rolled past real slow...looked at me and said "get out of here chambers!" (yes, all hermitage cops know me by name). he picked me out of the entire group and told ME to leave....so the like 2 nights later me and a friend go to taco bell. as soon as i get in the parking lot, i didn't even have a chance to pull up to the line to get food. same cop came behind me and pulled next to me and started bitching at me. told me to not sit here anymore and that we were all loitering and causing trouble. he wouldn't even let me speak. everytime i tried to say something he would say "shut up, i'm not arguing with you" and continue to bitch at me. so anyway last night we were all there again. had all of our cars backed in to the parking spots. we were all eating food that we had purchased from taco bell. when i was done eating, i threw all my trash into my bag and put it in the garbage can. not even 2 minutes after the same cop rols in, parks right in front of me sideways, gets out of the car with a tablet and pen, and writes down everyones plate number. he goes back to his car, throws the pad and pen inside and announces "everyone here is getting a warning....except for you steve, you will be getting a citation in the mail" man did that PISS me off. i said "what!? you can't fucking do that! i'm not paying then, i'll be seeing you in court". he starts his shit "chambers, tonight is not the night to mess with me. leave NOW". i said "alright, but i have a question". he responds "goddamnit chambers don't give me any shit. fucking leave NOW". i said "alright i'm leaving NOW just answer my question". then he really got pissed and said "ok then fuck it, we'll do it the hard way". comes over to me, slaps handcuffs on me, rips my cigarette out of my mouth, throws it on the ground and walks me to the car. i turn around and yell "hey! does anyone have a camera phone!? take my picture!" that pisses the cop off even more and he throws me against the car and pats me down then throws me in the cruiser. so on the way to the station i say "hey asshole you think you tightened these fucking cuffs enough!?" all he did was cranked up the radio and ignored me. got to the station, as i get out of the car i smack my fucking knee off the cage inside the car. there was another cop there and as i get out i say "hey officer blair look i'm arrested!" (just being a smartass) he gives me a shit eating grin and replies "that is CORPORAL blair, not OFFICER blair". i respond "oh, SORRY CORPORAL blair". so i was basically fucking myself but i didn't care because there was no reason in the first place to arrest me. anyway after a while of talking, i get charged with CRIMINAL TRESSPASSING! isn't that some shit? i'm thinking about just paying the fine, and then pressing charges on the officer who arrested me. anyone have any input on this and what i should do? i want this erased from my record.

noting will stick against a cop. not even if you have 300 teenage witnesses. the only chance you have isto talk to the manger of taco bell where you were arrested and have him come to your cort date, or sign a notirised document claiming you are a paying customer and were not trespassing. End of Case!

Make sure to have all your friends that were there testify on your court date, or else you cant do shit. Assuming their all over 18 that is

Ok first of all, I would get a written statement from the taco bell that you had purchased food. Therefor, that gives you every god damn right in the book to sit in the parking lot and eat. Also, what fucking right does the cop have in harrassing the shit outa you, unless the manager of taco bell or something is complaining? You are a paying customer, and should be treated as such.

Second, (I do not recommend doing this or will be held responsible if anything should happen because of this, use your own discretion)

After the court date, I would totally fucking find out where that cop lives, and TP the shit outa his house. Get like 4 or 5 ppl, and do it at 2 or 3 in the morning, when hes sound asleep. Don't do anything destructive, just give him a harmless mess to clean up the next day. Draw a taco in the yard with whip cream, that way he knows it was you, but indirectly. That would be totally awesome, but risky, since he is a cop and all. I would still do it though.

Go to court and fight that shit. Get the management of taco bell on your side, and your home free. He would have nothing to go on.

Holly shit that it is bullshit! That cop sounds like a real ass! I thought the cops around here were bad. I would deffinitly fight that shit. Take all your friends into court with you, and some kind of proof from toco bell that shows your purchased food there.

Wow, this asshole cop was really on a power trip. If you still have your receipt from taco bell, use it to prove that you where a paying customer. If the receipt has the time on it, then compare it to the time of your arrest when your in court. IMO this cop should loose his job over an act like that.

What a dousche bag seriously....you had food, you had friends there with you who saw you eating food, cop arrested you for asking a question....if you have a few friends and get a decent lawyer you can sue and cop will probably get in trouble....if not, find his house, slash his tires and shit like that.....I don't go around breaking other peoples shit for no reason but this guy has it comin' to him....lol think its funny the cops know you by name...I'm almost glad I live in a town where cops have bigger things to worry about that loitering...and trespassing is going onto private property without owners consent....If taco bell served you you werent trespassing. Even if you don't have proof you ate there that night, unless the manager comes in and says he told you to leave and you didn't, they don't have any real proof against "trespassing". Who knows, the officer may get a reprimand...oh and if it were me I would clearly state that any corporal may suck my balls just as well, if not better, because of the experiane being a lame ass bitch required to reach that rank, as a lowly officer, because I don't give a shit about offering respect to someone who can't do the same to me. Ok, here is the thing. If you buy food from the establishment, keep your receipt to show you him you paid for food. After you have eaten the food, your business with Taco Bell or any establishment is concluded.
Yes, you are loittering which is a misdemeanor charge if you have finished your meal and are still taking up space. The manager called to complain I am sure. I don't know how many of your friends were with you but you have to see that if it is 5 or more people in cars then that is the number of parking spaces a customer cannot use for example. Personally he should have had the balls to go out and ask you guys to leave if he has a problem with you folks hanging out there.
From your post, it seems you have had a few dealings with him before, since he knows you on a first name basis and he has had complaints before about loittering there. However, whether you disagree with him or not, he did give you and the others a lawful order. He could have charged you with misdemeanor Obstruction of an officer as well, for not leaving when told to do so. However, if what you say is true about his conduct, which I have only heard your side, his conduct was unbecoming of an officer.
Whether he was angry or not, he should have kept a professional bearing. What you can do is file a complaint with his immediate supervisor, which will be a Sgt. You can also file a complaint with the Professional Standards Unit (Internal Affairs) at his Department.
The best advice I can give you is try to find a place where the management will allow you to hang out. If you ask the manager and have permission, get it in a written letter and keep it with you. Then the officer will not have a leg to stand on in that regard.
I would however, make a point to report the conduct to his superiors. It may go somewhere or it may not. But if you don't report it, it will definately go nowhere.
Also. If the judge dismisses the case, you can have the arrest expunged from your record. It takes an attorney and will cost around $300. At least in Georgia it does.

One more thing. Do not go slashing tires or any of this other stuff these guys are telling you. If you get caught, you can be charged with multiple minors and a couple of Felonies.
Deal with issues the right way and the mature way. I understand that you are angry but there is a right way and a wrong way to deal with things. I have to deal and have dealt with so many people that have made the wrong choices in how to deal with issues.
These individuals are in jail now and some going to prison. So think twice about a course of action, if it is illegal. Don't become another statistic.

lol, me and my friends always hang out at walmart, yeah, not shit to do where I live either. We have to park really close together and roll are windows down staying in the car to talk to one another. Cops patrol that fucking place 24-7. We used to get out of our cars and join up with other groups and talk and shit. Then the damn cops started coming and telling us to leave because we were loitering, and threatens to write are names down, thats bullshit. Haven't been arrested yet though, lol. Hell I was walking to my car with a damn walmart bag with a dvd in it and they still told me to leave!! wtf!! Anyway, thats fucked up what that cop did, hope that fine aint to big, but I dont think those charges on that cop will stick, but what the hell give it a shot :smile:

If your court still hears this bullshit after you explain you ate food and got arrested for not leaving immediately, add the judge to your list. I'm glad I don't live where citizens put up with that shit. Get all of your friends into court and ask the manager for written proof of eating there. The cop won't get in trouble because all of them are hypocrites to the moral standards they (sometimes) uphold.

Your 'crime' of sitting in a store too long vs. the cop's lack of morals and being such an asshole. Makes you wonder how many police officers got beat as a child and dreamed of passing it on. I hope he gets hit by a drunk driver.

I would say to set the cop up... Have a friend with a camcorder "hiding in the bushes".... wether it be in a car on the other end of the lot OR IN THE BUSHES... do everything just like you did that same night you were arrested...
DON'T act like a dick... be as professional as possible and try to get him to "fuck himself" and get the whole thing on tape... If you go to court with video then there cannot be any of the "he said, she said" shit whatsoever... and YES keep the receipt with time and date on it...

if one of the towny cops around here did that he would need a new mailbox right about now. I had to deal with a dickhead cop once, I was taking my friend to the hospital (split his head open). It was really shitty weather pouring rain about 4 am and my tires slipped around a corner and I clipped a park car. No one was injured in the accident and the hospital was a block away so i drove my friend to the hospital and went to the police station shortly after he got out to report the accident. Cop tried to give me leaving the scene of an accident and not the summary offense the real deal. My friend had to get 5 staples in his head and my seat was covered in blood. Luckily the judge was understanding that my friend needing medical attention was more important than waiting for the cops. Anyway good luck dude, avenge this wrong in the court room first then do what you gotta do.

actually, if only the drive through is open, you're not supposed to sit in the parking lot and eat, you're supposed to take it somewhere else.

well here's the update...we got an attorney, $400 for him. went to the office and pled not guilty. they're suppose to contact me and tell me when the court date will be. the attorney seems very confident that the charges will be dropped after everything. i told him the whole story. didn't leave any details out and he feels that the officer was wrong in arresting me. the attorney is even real good friends with the judge :) so hopefully things work out and it gets erased from my record. thanks for all the replies and i'll keep you guys informed.

i hate that shit, just cuz a tuner has a halfway decent attractive car(not saying yours isnt, i have never seen it) but if a cop notices an exhaust, loud radio, etc... they think they have the power to harass anyone they want and nothing can be done, but dont just sit back and let him get away. do everything you can to get his ass suspended, if not fired......I fucking hate cops!

I personally don't think anyone should hate all cops... not all are bad... but there is always the "bad seed" or two... I have had a few run-ins with the bad seed also.... sux but it happens...

ok everyone this thread is a little old but i was told to keep everyone updated....here's the story...

FINALLY went to court over this stupid shit. make a long story short, my attorney and the officer who arrested me came to an agreement. all charges will be dropped if i go 4 months with out loitering anywhere. so 4 months from sept. 28th i have to go back to court and everything gets dropped :) still pisses me off though...i should have never got arrested to begin with.

That really sucks. Just talk to the management over at Taco Bell and make sure it's alright to hang out outside. Personally, where I work(Wendys), we called the cops on a group of people that trash the place outside and deal drugs several times a day infront of families and etc. Make sure that they know you don't mean any harm by being out there.
