Help, some advice

Ok, i'm pissed of wright now, you can't believe it.
Last week it was time for my lady to replace the brake discs and the brakes, plus the car needed some new oil. This was urgent. Plus it costs a bit money too. So i decided to take her to a garage and not to the dealer she came from.
No problem plus this is cheaper and i heard lots of good things about this guy.
The day after she was back (thursday i believe) I took her for a spin (nothing fancy just cruising) and when i came back half an hour I noticed a burning smell plus the car whined like crazy!
I was like :confused: cause that's the first time i smell such burned things, don't know how to call it. It smelled like something dry has burned, maybe air.
And the whining noise was oc from the turbo cause it already made that noise but much softer, cause back then it was still a normal turbo sound.
The whining is the loudest when your standing still and you give some gas. When you let yr foot from the gas she goes like whhhuuuuUUUUNNNnngg, ieeeoooooeeww. but very loud when you normally just could hear the turbo through the motor.
Needless to say i see the burning smell and the turbo like one problem. So today i took her back and told the guy what was the problem. He said that the smell probably was something with the exhaust and that i didn't need to worry about that whining noise cause that was probably the airco. I was like wtf :screwy: i was already sure that was the turbo.
And i hardly know something about engines.
Anyway i told him to check it out very carefully and then call me.
Well, so he did and he said that the turbo is going broke and that for a new one i will need to pay alot...
I was like wait a minute, what have you done with my girl the first time you messed around with her. Before he took her under his hands she didn't had any burning smell whatsoever plus the turbo was topnormal.
And now its all messed up.
I made him clear i wasn't very pleased cause this all must have happend when the car was with him! he said this could be already busy for a long time. BUt i never noticed anything wrong!!!!
I don't know what to do. Plus i still need to pay him for thos brakes and discs. He will now keep that car there untill an expert comes when i plan on doing something related to the court plus i won't win he sais cause he is insured.
This plus the trembling voice i heard at the phone with him keeps me thinking HE made my car worser then when she got there.

Your car has a turbo??? since when??
In terms of court, you can sue in small claims court for breach of contract, if he failed to properly perform... if you can prove he specifically screwed up and made the car worse, you can sue for commercial negligence....but u gotta prove it, then u can make a bit of money to get the car fixed
In terms of the whine while starting, my buddies civic does that every time, and his cars been in for inspection and nothings been wrong...personally I thought it was the tranny, but im no mechanic
The one thing Id say is take it to the dealer, find exactly whats wrong, then compare to the private mechanic and go from there

I don't know how the justice system works where you live, so I'm not going to recomend court or not. My advice? Do what you should have done in the first place, and take the car to BMW.

Well my car has a turbo since it was installed when she rolled out of the factory. :smile: it's a turbo diesel engine you know. But it's a small stock one, not an upgrade. But that's the problem. It can't be worn out already. The car has 156144 km's.
In terms of court, my dad is now talking with his laywer. He's pissed of also cause he eventually told me that man was a good man who knows alot of BMW. He's gonna take care of it. I don't need to worry about that now he sais, cause my animation work for school goes first for him and for me.
Morning i have her back and will probably go straight to the dealer with her. Wonder what they will say...
About the wining noise, it's really the turbo, and it's not only when i start her, it's continually when i let of the gas even when i'm driving. The garage guy said it also so it must be the turbo. That for it can cause that eventually you will loose the control of yr car and the car will have his own life, by terms of speaking. The car can suddenly pull very hard just on its own. The turbo needs to be replaced.

Cause i don't get it that this all can happen in like one day and a half without me noticing it myself until i get her back from him.

1) it doesn't sound like the guys fault
2) even if it was, you wont win in court.
You said you have 150k km...I don't know how many that is in miles, but I have seen turbos wear out in 60k miles...generally some can be expected to wear out at 100k miles. When they go bad, they will burn oil (accounting for the smell) and they may have shaftplay (which is when the compressor wheel wobbles and hits the metal housing) This will cause a metal on metal whine aka the whine of death.
Now this could be caused just from age. Another thing is you may have sucked up something that damaged your turbo. This could be caused by something getting into the intake piping...or by somebody dropping something in the intake piping. However, you said he was working on your brakes and oil change...there is no reason to take your intake piping apart and expose an opening. Other than putting new oil in the car, he had no reason to be in the engine bay at all. Hence the additional difficultly of proving he had anything to do with it.
I'm sorry to hear that this happened. It is unfortunate that this happened when you tried a new mechanic. But I wouldn't jump to conclusions just because it was a new mechanic....it seriously may have just been horrible timing. I personally despise dealerships, and after working at one, can say for sure, that even though they sell the cars, doesn't always mean they know how to work on them either. Let alone they charge you ridiculously. Anyway, back on point, I'm simply saying that I am guessing that the dealership will say the same thing, and you probably don't have many options other than getting a new turbo.

Igovert. Tx for the explanations. That's about the amount of miles you said there, so the turbo must have worn out. And it seems the explanation of the burning smell and whining noise fit in.
So yeah, probably bad timing, but still. I can't exclude the other option. But i have to admit he took care of the brakes rather well plus he lined the car back to normal and she rode great again.
About the dealership. You know BMW trains their people extra cause of the difficulties of the car in general compaired to others, especially with the newer generations and i never ever complained or needed to with them. Only the amount of costs. Wich is wy i took her on others advice to this guy.

My dad's laywer still sais that's it's best to send a signed letter to the guy and let an expert handle this. Then she gets back pronto to the dealership. I'll keep you guys informed

i need to pay for the work first that's already done. And then the engine needs to be fixed. so :icon16:
If i would put in a bigger one now it would ruin me for a couple of years. Keep in mind the fact that road taxes hear aren't cheap and they count in horsepower. It would be out of this world for a student like me. so nope, let's wait a couple of years for that. If i still have her then. :smile:
But with the new turbo in place she will be like new, i hope.
Maybe after summer when i made some money i can start the plans of intake headers exhaust. Those are the first on the list. And i'm looking for a kind of chiptuning.
But let's just first see what comes next week.

What do you mean by road taxes? Don't they just look in a book, and say the 320d had 200 hp, and they charge you a certain tax. You don't have to tell them that now your car is making 300 hp. I'm just pulling these numbers out of my butt, but I don't think that they would dyno test your car just for tax purposes.

They do in Europe and Asia...I was reading something in Asia, where they figured out, to own a GT-R, it would cost you almost 10K more after the purchase for all the taxes and insurance you have to pay.

So, i called With BMW Belgium and a guy said me that it was well possible that it's just coincidince and that i have the wright miles on my car to let that happen.
I'm going to get her fixed with the guy were the brakes were fixed. Already made my appologies to him at the phone and he said that's such reactions are understandable and that he will fix her up with a nice discount on the turbo. :biggrin:
That makes my day again.
Let's hope i can call a quit with this disaster chapter, and say: end good all good :smile:
So, i called With BMW Belgium and a guy said me that it was well possible that it's just coincidince and that i have the wright miles on my car to let that happen.
I'm going to get her fixed with the guy were the brakes were fixed. Already made my appologies to him at the phone and he said that's such reactions are understandable and that he will fix her up with a nice discount on the turbo. :biggrin:
That makes my day again.

Guys, this is awesome. He got a free turbo fixed for me that he get from BMW Belgium. :lol2: awesome.
This guy is really good at what he does with BMW's, stayed with him an hour or so when he was working at another 320d. Mine is still waiting for the new turbo that should be with him tonight.
Like Igovert sais it really is better to not go to those dealers who charge ridicously much. But then it must be a mechanic that knows his job oc.
I think i'm gonna stay with him if he fix this up well. sorry Cassiesman :uhoh:
Must admit the shock of hearing the turbo was dieing without me never noticing did what i thought was his fault. I was wrong there. You can expect kills or losses again in the next week.
The car i got from him as a replacement for now is an old school 3series with a farting sound sometimes when standing still but has an nice engine sound when you go in the rpm's. i like this car just to drive it for fun.
It looks that this is all cleared out :biggrin:
