Trans Program error

I have researched this problem to death without any resolve, someone give me some solid advice before I actually resort to taking the car to the dealer.
We have a '95 525i with 100K miles and the car will not shift into fourth gear. In third (or any other gear), it will reach about 3500 RPM and the trans program error will appear. We shut the car down as the manual suggests and start it again and its fine, until about 3500 RPM.
I called a dealer and they see this as a A/M switch problem, but wont know until they get the car in to see it. Other forums discuss it to be a fuse or software problem. If anyone else has had similar problem, please left me know what you had to do to resolve it.
