I just got pulled doing 83mph in a 45 by radar. $275.

than fucking sucks... there goes some of that S/C money. were there any hills, if so you could try to say there was an inaccurate reading due to the cosine effect, you can research that more if u want. if u can convince the judge they might lower the violation some, and therefore lower the cost some and the points on ur liscense.

Can you give us more details? Where it happened, what conditions, etc, we might be able to give you advice on fighting it.

It was a straight road...no other cars. I went 0-100..and broke..he caught me braking at 83mph.

BTW: I'll pay the $275 no problem..I just need to get out of the points.

Well, not much you can argue about accuracy, unfortunately.

if you did it why fight it?

Dont try to fight. you will just piss off the judge. appear to court and plead Guilty and they will give you a better break then no contest or not guilty. Judges appreciate honesty.

Also i dont know what the heck the cosine effect is. Maybe you are thinking of an ionispheric bounce. also plead guilty and question the officers certification in radar. only about 10% OF Police Officers are radar certified and if they are not it has a good chance of being dropped.

Edit: Not anything to you Dampachi, but isnt there a traffic violation forum? you see tickets posted in here all the time and then you see threads locked for being in the wrong spot.

It was $275!?! My ticket for street racing in city limits wasn't half that. Just be lucky he didn't catch you doing 95 or you would of had a felony and man slaughter charges on your hands.

Racing is much more of an offense than speeding.

becuase you have the chance of the cop not showing to court.

Well, still try to fight it. Just show up in court in a suit, be respectful, and say that you can pay the fine, but you're worried about your insurance.

Manslaughter? I don't think you get charged with accidentally killing someone for speeding lol. Reckless endangerment maybe, not manslaughter. That sucks though dude, sorry to hear it.

There wasn't an interstate nearby or anything?? Fine wouldn't have been nearly as much probably.

It's the first time I've ever been pulled over. I'm just glad it wasn't for anything worse. I'd consider this somewhat mild..haha...

Yes, manslaughter charges can be filed. I don't know how it is from state to state but in Oklahoma if you're going 40 over the speed limit you'll get charged with unintentional manslaughter. They say that going that fast over the speed limit is a threat to everybody's life on the road.

Manslaughter??? Manslaughter is when you actually kill someone, but didn't do it intentionally. Unless you have a different meaning of the word than here (NY) then there's no way they could put that on you.

Just read what I said. I don't think there is anything better than that. BTW, did you admit guilt?

Tell them it was your first offense, and ask if you can recieve a supervision program even though you exceeded the limits of the program. Speak respectfully. Always comply, dont argue. This is coming from someone who has been on supervision twice (at same time) due to good reasoning. Well actually the second time I only got supervision thanks to my grandfather (criminal attorney) coming with me.

i forget who it was... but someone said they never heard of the cosin effect, im not sure how it works but its very real. my bro got out of a ticket using it, only difference was he really wasnt speeding and the cosine effect actually did cause the error, but the cop was a twit. since there were no hills or turns or anything dampachi cant really try that one tho...

Well, did the officer come up and ask "Do you know how fast you were going?" if he did, what did you say? "I was gonna go up to 100", or "I'm not sure officer".

See if you are eligible for Traffic School. Seeing that this is your first offence, without a doubt in my mind you will be. That will take car of the points. And don't worry, I've sat through a few traffic classes and they aren't that bad. You learn quite a bit about cops during the process which is a real eye opener. The ones here in Utah range from 1 1/2 hours to 3. But to tell you, TS is definitely worth your time and money. Plus it keeps the points and ticket off your record. I highly recommend you do that. Need any help just ask me. I've done it a few times myself.

I'm not sure exactly if you have to see a judge about that one. Maybe you can speak to a Traffic Referee. I don't know MD laws. But if you can speak with a TR, then you will be able to set up for TS no prob. But unless you are ordered to see a judge, then all I can say is be honest, and always say "yes sir" and not "yeah". Judges get pissed. I learned that from watching some guy saying "yeah" to a judge like 10 times. He wasn't fortunate at all when it was over. Good luck bud, and sorry to hear about your ticket :(. L8...

Considering the fact that it's 38 over, I doubt traffic school will be an option, but definetely worth a try.

CivRacer95
03-09-2005, 08:49 PM
If he has to go through a judge then, and this is his first offence, and if he's well mannered, the judge will most likely allow it. The first ticket I got was in my TA, like doing 30 over. The cop lowered it of course, but the judge still saw 30 over. I remained proper the whole time I was in court, and sure enough the judge lowered my fine, and allowed for Traffic Schooling. L8...

I said 'yes sir' and 'no sir' and 'thank you' and all that what not. When he came up to the window..he asked "Do you know why I pulled you over?" I replied "No sir"...because I honestly didn't know. He didn't pull me over for like 3 miles. Oh well.

I really don't know what to tell you dude.

1. You could go there an be argumentative, challenging everything, then dragging the court battle over months, but I wouldn't recommend it.

2. You could humble yourself, admit guilt to the judge, and ask for mercy. Not guaranteed to work either, but the results might be better.

At least in Michigan, where I live, suppose you get a ticket in January. You say you want to appear. You will probably get a February court date. This is the informal hearing between the judge, cop and you. You loose, and ask for a formal hearing with a prosecutor. By this time it's March/April. You lose the formal hearing as well. You can appeal the ruling. Next court date is April/May. You loose again, you appeal, next and last court date is May/June, maybe even July.

$275 is not all bad considering I was levied a $153 ticket for ROLLING THROUGH A FUCKING STOP SIGN...I'd pay the ticket, take traffic school online, get the ticket off your record and move on with your life.

Dampachi, where were you when you got this ticket? I live in MD too and I was coming home from Ocean City this summer at 1:00AM and got a ticket for 85 in a 55. You're going to have to take a traffic class, I think that's 5 points for you. I went to court and they lowered the fine to $70 for me, but I still got all the points :(
