Hi!I am new here and I wanted to know if anybody could tell me anything about this.Ok well,my boyfriend got put in jail for unpaid tickets.(I am always telling him to pay them,he wont listen).Well,I called there and they wont let me post bail cause they want to make sure he goes to court on monday.Well,he had 2 warrents and on the other one, his bail is 150.00,well,I asked if after court on monday can I pay that one where he is now and get him out and the lady said they wont know any thing until after court, she said the judge might sentence him or set a bail for that to.Well I just thought he would get time served for that and then I could post 150 for bail for the other and get him out.I am freaking out now cause I am afraid the judge will sentenced him to time in jail!We have a 3 year old and I stay home with him,so I wouldnt know what to do.Can he get time in jail for speeding ticket,no proof of insurance, and falure to appear in court? This is not the first time this happen either, so the judge will look at that too, wont he?If anybody has any info, please reply,I am scared! Thanks in advance.

what they're keeping him there for is for the arraignment. He will probably talk to a public defender before then and decide on his plea. If he pleads guilty he will probably be sentenced that day. He will probably have a fine around $1500-$2000 and probably some community service considering his prior record.

This guy sounds really irresponsible, not the person I'd want to raise a kid around, no offense.

We have a 3 year old

hmm well isn't that just great...

what does your boyfriend do for a living?

can you do me a favor? break up with your boyfriend, start dating a nice, responsible guy who you will not be particularly attracted to and has never been in prison, marry him, and take the kid with you.

oh, and get some therapy.

yes he will get time in jail, as he should. It's really NOT THAT HARD to stay out of prison, contrary to what some people seem to think. Its a little more difficult to not get pulled over and/or tickets in the first place, but still pretty easy. and this is a second offense? Geez... I get pulled over all the time, hell I'll even tell you I'm a crappy driver, but somehow I've never gotten a ticket and never seen the inside of a courtroom.

Well you've had two people give you advice for your personal life yet no-one answer the situation at hand. I've only heard of one person going to jail for tickets. He had 2 or 3 DUI's, failure to appear, driving without insurance, driving on a suspended license, reckless driving among a couple. He was sentenced to jail for a year. It made me feel real good to hear that before I went up for my ticket of 11 over... to answer some of your questions:

Can he get time in jail for speeding ticket,no proof of insurance, and falure to appear in court?

1. Yes, if hes speeding enough above the posted speedlimit. I know for a fact you can face jail time for reckless driving.
2. No proof of insurance... as long as he can go to court and prove that he did have it while he was pulled over. Otherwise he faces some hefty fines. On top of court costs, DMV will usually fine you $500. He also will have to file an SR-22 (Signed Risk). This is basically a promise that you'll have insurance. It jacks up your premiums super high and you HAVE to have insurance for the next 3 years otherwise you face fines from the DMV.
3. Failure to appear, yes. It also depends on the charge he failed to appear on. If it was something such as speeding 8mph over, they usually just send the fine and you have an alloted amount of time to pay it. If you don't pay it, they suspend your license.

Usually when you don't pay fines they suspend your license. When he was pulled over, he was probably caught on a suspended license as well.

Hope this helps, may be he'll listen to you and pay those fines for now on!

Well,Thank you so much! And thanks for not being rude!lol! The falure to appear in court is because of no proof of innsurance.Im not sure how much over the speed limit he was going.I just thought he might get time served.Well, thanks again for your reply!Yes,it helped!

I'm not rude, I just have a complete lack of tact and come across as rude over the emotionless internet. Anyways, I could probably pretty accurately guess quite a bit about your family history and/or childhood based on your original post. Phsycology is complicated, but once you are exposed to enough of it patterns emerge. Where is your dad? Trust me, therapy wouldn't hurt. Just out of curiousity, (without meaning to be rude or offensive) did you go to college?

Like I said I have a complete lack of tact and have been known to claim american ignorance at times. Be what it is, it doesn't matter. good luck with whatever you are aiming to do.

ec437...chill out...I happen to have found it pretty rude as well. I don't care if you lack tact, you are coming across as a prick. She asked a simple question, you have yet to offer a reasonable and relevant answer...if you are incapable of doing so, I suggest you refrain from posting.

The girl is in a predicament and could use some advice and understanding...not your judgmental elitist bullshit.

Mariea, I'm assuming this is a bit late, as you mentioned his arraignment was today.
I would doubt they would give him actual time...as was mentioned, fines, suspended license and community service sound much more reasonable to me...

We hope it went well and wish you the best.

Failure to appear on the charge of without proof of insurance. If you don't appear on these violations the court automatically finds you guilty. His license was probably suspended from the court as well as from the DMV. By this, he probably has about $150-250 worth of fines through the city court. He also has about a $500 fine from the DMV. He won't be able to get his license back until he pays these fines he ALSO will probably have to file an SR-22. Basically, since its illegal to operate a vehicle without insurance, the DMV keeps tabs on this through this form/program. You have to ask your insurance company for the form, fill it out and take a copy to the DMV. This makes the insurance company notify the DMV if you ever default or don't have insurance with them anymore. You have to have insurance for a solid 3 years, miss a day and the 3 years start ALL over. You're insurance company will raise your premiums when you have an SR-22. Also expect to pay $75 for a license re-instatement fee. Oh, and you're also going to have to pay those outstanding tickets plus any interests that they have aquired.... thats all I can think of right now...
