If she hit you it doesnt matter that you have liability insurance. She has to pay for this, or her insurance. The only prob would be if she wasnt insured, and if that is the case take her to court.

who cares if it was in a parking lot. her insurance company (and yours) can investigate and still make her insurance company pay...

If its in a parking lot that only means the cops cant give you a ticket because its private property. She still damaged your car and is resposible for the damamge. That is, unless your only telling part of the story and are part to blame for the accident.

Damn bro, I am sooooo sorry to hear about that. How the f*ck did she run into you in a parking lot? Damn, personally, I don't know what I'd do. If it was a guy, it'll be easy....either pay up or beat the crap outta him and then take the money. LOL But since it's a girl, that's a hard one....maybe tell your sister or your gf to go beat the crap out of her if she doesn't have insurance. :p But seriously though, if all else fails, take her to court and get your car fixed. Hopefully, everything'll work out....
On a side note, how come it's always the case that when you stop paying for insurance or if you change it to liability, the moment you do something like that an accident occurs? Is it like some stupid curse from the insurance companies? Gateway, what do you guys be doing over there??? LOL :p

Really? So even though legally there is 50/50 fault in the accident, you can still prove that one side has more fault than the other? I know you're the insurance guy so how's that work?

It's called murphys law :). And I believe you should get your money one way or another, try to guilt her parents into paying for it if you find out that her insurance won't pay up, if that fails threaten court and then take them for all they're worth!
I think if she is the one who hit you she's at fault, and unless you can drive sidways, how would her front (or rear) bumper come in contact with your car as you drove along?

Yeah, but the way the law looks at it, none of that matters, no one has right of way in a parking lot, it's always 50/50 because the lines/signs on the parking lot mean nothing legally. I don't know about other states but in NY they took away the right of way law for any situation, you could run a stop sign at a 4-way stop when someone else was sitting there first and it would be 70% their fault if you hit them! Because supposedly the car in motion should be yielded to, but in my opinion, why even have traffic devices or signs with that kind of rule. But I do like to take advantage of the law and run straight through the 20 stop signs that surround the mall near here, especially when there's a cop or security sitting right there. As long as there are no pedestrians or cars in my way, they can't pull me over for sh*T. :)

Its true that the signs and lines mean nothing in parking lots, which is why I dont follow them, but I do stop for people.
However, there can be fault in an accident. If you are going strait and a car hits you in the side, or backs into you, it is their fault.

yeah brah that totally sucks, but hows this its not as bad as yours but i watched it happen to my car. So this girl i know just got a nice integra(personally not my favorit but nice) any who. i got to her house first and spocked her car in the shadows then i parked in front of it. She was trying to keep it secret but i found it. So about 5 minutes later everyone arrives and were all checking out here teg. Then someone suggests to start her car with the remote start. She hits the button and the car starts to jiggle. Then it starts to roll forward and i watch it get closer to my car. My stomach drops as i watch her car push my car back about 5-10 feet. To describe that, its like getting kicked in the balls and u cant do anything about it. THere was no damage what so ever but it was friken hillarious.

My mom ramed my car when it was parked behind hers instead of getting out and telling me to move it... I promply tracked her down found where she parked and disabled her Sienna, she didn't get it back for a while ;).

99% of cases, no matter what, someone is still "at fault"
call your insurance company.

cops around here can charge u a 20 dollar fine per parking row u drive through. my friend had a 2000 mustang and he was pullin out of his spot at school an this girl was flyin through there an totalled his front end, he only got like 3 grand out of an he had to put his car in a junkyard. but his car was probably worth 15k

i just recently had the same problem.... car was in the school parking lot, and some asshole backed into it... ( pics of damage)http://briefcase.yahoo.com/billlashinsky
as long as you know who did it, and you can prove that you WERENT in motion in the car, their insurance will pay for it...(unless they have none)
the only problem is....depending on the year of your car, most ( 90% +)
insurance co.s will only pay up to 75% of the blue book, meaning...
HOPE YOUR DAMAGE ISNT THAT BAD.....IE...
blue book-3750
damage - 3500
the insurance company will only give you 2800 bucks....
and trust me i just went through this exact same thing....

Not true, they pay the blue book. If you let them give you less than blue book then you got the shaft. My insurance company (diff. than who I work for) tried to say it would only cost $350 to paint my hood. I complained and it turned out to be about $750 to paint the hood and they covered the difference.

i just went through it, they may pay the differnece on a supplemental report....but as for first payment, the adjuster will come out and see if he can find used or aftermarket parts for your vehicle, and that is how he gets the price....

just my 2 cents here but if u take her to court get the money for ur car and ur court fees or else theres no point in going to court cause u might as well use the money to fix ur car!! and by the way dont sell it u'll regret it...
