Warranty and binding brakes (HELP!!)

I have a 1.8 T (18 months old) and the rear passenger side brakes are binding. VW say i'm not covered under warranty as nothing to do with brakes is. Surely this is a mechanical fault in a car this old and i should be covered.

Does this cover me?????

Also, will my pads have worn down as a result of this and if so should i be covered for new ones?

I have to take my car in tomorrow so a rapid response would be appreciated from someone in the know
