I just got back from my court trial. I was being charged for B&E with attempted larceny. Heres the story, a friend and i tried to get into another friends house to get back our video game. Next door neighobors cought is trying to get in, and now they wont drop charges..anyways..

I was made an offer. I cant do shit for 12 mos, and have to do 25hrs community service. Thats right. Lets say i get into a fight. Not only will i be charged for assult and battery, but they will also bring up my b&e charge. But, if i do go 12 mos being "good" with the community serrvice, they will just completly drop my b&e felony charge.

I dont think the neibors can press the charges it it wasnt their property. Your friend could since you were caught but not his neibors. Anyways just be good for the 12 months and do the community service,(CS) I do alot of work with CS's and if they behave and do a good job Ill right them off with less time left to serve. Here, if you supervisor feels you have done a good they can give you up to doulble time, Ive writen guys off who had 50 hours after they have only completed 30, as long as they work without any attitude and get the job done I have no problem being a nice guy, If you are a major pain in the ass however, we can also recommend to the judge that you get even more time. Just remember your ass is in there hands, dont bite the hand thats feeds you so to speak. :lol2:

Even if the owners of the property didn't press charges, unless they come out and say you had a right to come into there house, the state will prosecute - regardless of the reasons why you were going into the building.

Whats wrong with being 'good' for the next 12 months. I've gone decades without getting into a fight (off the hockey rink) or broken any laws besides speeding. Do your community service and keep your nose clean. You might just consider the consequences of your actions and take a better approach to problems you are confronted with.

...I'm not trying to be a smartarse, hence this is a serious question

...What if it is YOUR house, you locked the key inside, and you're getting in, and your new neighbours didn't know it was your house, or, someone walking past see's you breaking into your house....will you get charged then?

If you had been previously allowed to enter their home under similar circumstances you have colour of right to do so again, and they can not press charges (unless you jimmied the door or something). At least that's the way it works in Canada. I believe that the USA has something similar to our colour of right law, but honestly I know nothing of American law.

Consider yourself lucky.
There is NO excuse for what you did. You committed a property crime and frankly you are getting off easy.
Straighten up, don't break the law and think about your actions before you do them.
