Escape Starting Problem

My son has a 2003 4-wheel drive V-6 Escape, auto-trans that has a rare but unpredictable starting problem. After starting the engine from cold start, driving awhile, and stopping for a few minutes, the vehicle will, on rare occasion, refuse to start at all. He can let it sit idle for awhile and the engine will then start as though nothing was wrong. He has contacted the dealer and got the very stupid answer that the "computer was just learning his driving habits." He has contemplated taking advantage of Texas Lemon Laws and just dump it on the dealer. Has anyone had experience with this problem?

the problem is at the starter. the connections can be tightened,if you disconnect the negative battery cable, you can tighten the 2 connectors at the starter and it will go away.

I think it is the ECM programming. New vehicles run in a predetermined program until the engine is up to temperature and the sensors are sending back usable values. The computer runs the vehicle in this closed loop mode until it warms up a little. If you shut it off too soon, you can make for an engine that is hard to start. I've experienced this with all makes of new vehicles, especially Japanese. Nothing you can do, let it warm up before shutting it off if you have to start it right away.
