I got Uber ripped off...

So I bought this cute little red CRX you see in my signiture. I was told that it had a b18b1 motor in it and it was an HF, so i was all excited it had a quick motor and a light weight body.

First i spoke to him he told me 5600. then i went out to see the car and the price jumped to 5800. Then he told me he would include the 2500 watt sub amp with the car for 6000.

AFTER buying the car (which I am responsible for being ripped off for doing my research after paying way too much) i found out its a ZC DOHC non-Vtec motor... Its a DX model, no air conditioning, the body kit is fake, and very poory done. The distrubutor needs to be replaced and the car doesn't start all the time.

So traded my 98 ford ranger, and 3400$ for a 1988 DX with a ZC DOHC, with a fake skyline front end, (fake?) mugen side skirts (fake?) buddy club rear end. And he took out the amp!

The car DOES however, have a full straight back carbon fiber exhaust, OBX Short Ram intake with KN filter. Interior is all wrapped in leather, matching red and black. Carbon fiber shifter and e-brake handle. Sony 50wx4 way CD player head, 4 sony 3-way speakers. 2 12" 600 watt subs, he took the amp out before selling me the car.

I am really pissed about this. All the work done to the car is really cheap, I already had to take off one of the doors to fix the mirror because it didn't roll up and align properly so there was always a gap. almost all of the moulding for the windows is coming off until i get can more airplane glue stuff.

Sometimes i wish I wasn't such a n00b.... bleh...

Tell me what you think I should say to him?

Well first of all, show up at his door with a base ball bat and ask him where the fuck your amp is.

From the pic in your sig the body kit looks like it was done ok. And you'd never find a real skyline bumper to fit your car so of course its fake. And the mugen side skirts and door caps are so rare so its probably just a WW set.

Next, how is it that your 98 ranger was only worth $3600?!?! I mean its a ford, LOL, but its a 98.

Nothing really wrong with the ZC motor. But it sucks he said it was a b18 thats worth like $1000 more than the ZC.

I'd seriously go back with a bunch of large friends and ask him about this stuff.

tell him he owes you an amp. hopefully you made some sort of written agreement for it *crosses fingers*. im not sure if he sells cars as a business, but bad list him. and if he doesn't, bad mouth him. i wouldn't reccomend taking him to court...cause thats more expense.

at least you know what you should look for next time you buy a car!

btw, if you have any spare keys for you're old ranger...
one night, very late, quietly drive his car back, and take yours back. leave the keys he gave you on his doorstep, then get your locks changed :evillol:.

lemme know what you end up doing, maybe i can reflect on what i shoulda done right lol

nothing u can do but persuade (force) hime to give u the amp and some of ur money back...take him to small claims court and settle it...but u should of had a written and notorized (sp) agreement made...

but in the near future...take someone who know about the specific car u want and/ or post about it up here

ditto, but when i paid the 700 for mine i didnt realize that it had about 400 worth or suspension in it and a 200 dollar muffler so i made out alright i think, car looked like ass but i friggin love it now, its so sweet since i've been doing my own work to it, i was looking at old pics before when i first had it and my god, what a difference!

but yea, back on topic, go back and ask him where the hell ur amp is

I think your car looks nice. Would like to see more pics of it (front, under hood, interior, etc.)... Yep, you probably paid too much albeit with trade but really there is nothing you can do. Small claims court wouldn't be worth it. You could ask about getting the amp, and it can go either way. If the guy is a dick about it then you know he's just asking to get it maybe not from you but he will just the same. If the guy is nice about it but tries to avoid providing it, you can at least probably ask him why and pester, maybe get a reasonable answer. The guy still sounds like a prick to me though. Good luck, man...

ooo i hate ppl like that...i'd most definitely go to his house with a group of ppl and at least get the amp, which is worth a couple hundred bux for a good one.

and THEN after you get it tell him all the crap wrong with the car. Then, get his addy and you can get his phone number from whitepages.com and maybe get his email from someone who knows him. Spam Spam Spam. Ooo i'm talking hundreds of emails a day. Just sign him up for everything from credit cards to magazinez to lingerie shops to flower shops. Sign him up for every mailout in america - he'll wanna move cuz his mailbox will be so huge. N then, tell everyone you can about how much of a poser he is. I know a whole ton of business owners around where i live, and i can give em his photo n they'll hike up the prices of everything for him, especially at the auto shops, repairs, body, audio, etc. Heck, i'd definitely raise some hell.

But, what's done is done. After ur done makin his life miserable, you can try to make the most with what you've got. It could be worse! My friend bought his civic, and it ran awesome for a week. He had to replace the ECU (the ppl painted the cover of it to look new but it was all rusted out inside), new exhast system (O2 sensor, etc), glove box falls off, when you turn the AC on the car doesn't wanna go (they say the fuel injectors need replacing), etc. Least, next time you go for a car, you'll learn to post on AF first and take a REALLY REALLY close look at the car before you buy (2 test drives at least, bring a few friends with ya to look, if it has a body kit move the lip sideskits etc to see if the move, bla bla bla bla bla)

Actually you need to check your state laws. Here we have what they call a "lemon law". If you buy a car and find something wrong with it that was not disclosed before paying for it you have 30 days to return the car for a full refund.

marked001
07-01-2004, 01:25 PM
I dont think the lemon law is going to work in this situation..there is no warranty and it is assumed that the sale is 'as is'..

But the seller removed parts from the car and also gave false information.

unfortunately there seems to be no proof of that transaction, and even if he does get taken to court...who says he'll tell the truth? I hate people like the seller in this story. People can be real jerks...

pauls81sc
07-01-2004, 02:35 PM
I am not a legal expert but I disagree with these people saying there is nothing you can do. A verbal contract is a legally binding contract and if the seller misrepresented the facts about the car you can at least force him to return your money and your truck.

The biggest discrepancy seems to be in the motor (ZC vs. B18). That lie he told you is legally known as "FRAUD" and it is legal grounds for voiding the contract. This easily falls into the realm of civil courts. If I were you I would contact an attorney pronto and for a couple hundred bucks they can draft a letter with enough threatening language to stir this A-hole up and make him think twice about victimizing you. If that's not enough be prepared to take him to court. It doesn't cost very much at all to file a civil claim. You may even get a judgement that includes him paying your attorney fees.

I friggin HATE jerkoffs like this who think they can take advantage of people and get away with it. He's obviously some kind of scum bag (you might be more selective in the future about who you do business with) and deserves to get what's coming to him.

DO NOT LET HIM GET AWAY WITH THIS. Right now he's kicking back with some of his scumbag buddies gloating about how he took advantage of you. It's not even my money and that PISSES ME OFF. Get an attorney and turn his smug little world upside down.

Lovely idea. But again, the cost might not be worth the resulting fruit. All depends on the financial status of the victim. [btw I like your attitude on this, everyone [me included] has the exact opposite view, good job, i forgot about those options!]

If you've got the backing [financially] I say go for it. He's right, drafting a letter is especially effective. And civil claims court is not THAT expensive. Hopefully he doesn't let out another sackful of lies. Good luck with whatever you decide to do!

Heres another idea. Did he change out the guage cluster? If he did and it has the wrong miles on it that are really on the car you can get him for odometer fraud. I know in PA you can be fined heavily for that and even possible jail time.

Even you dont contact a lawer, you can still threaten him and say you did and make up a bunch of shit. Maybe you'll luck out and get him scared.

I am going to go see him tomorrow and tell him that he better do something or else I will do what I have to do to set things straight.

Hahaha, Ok... so here is a little update on whats going on. I am making payments on this car because of how much i am getting ripped off.... And I am supposed to pay 720$ a month until it is payed off. The guy said he wants me to pay on the 30th or the 31st of each month. The contract we have , which is an "as is" contract btw, never has a date for payment so i am not too worried about it. But he just left me a message freaking out like "I shoulnd't have to try to find you and call you to get your payment, you need to make your payments on time or its repo time, this isn't working your way"

When I go talk to him tomorrow I am gonna be like, "I am not going to give you another penny until you either reduce the price of the car or give me that amp, because you lied to me, and by lying you made this contract void because of a fraud issue" Now weather that is true or not is unknown to me.... but hopefully I can talk to someone who will know for sure before i go talk to him tomorrow afternoon...

Anyway... lalala!

The front end of the body kit is only connected by about 4 pieces of sheet metal screwed onto the body of the car. The side skirts are done nicely and the rear end kinda of jiggles. But the front end is bent up and almost falling off, I had to re-screw it on twice already. I am going to get a new one professionally done when i get th emoney.... but i want a b16 or a b18 first.

Me and my b/f went down to Honda later and got the report that he saw and signed knowing what was wrong and how much it woudl cost to fix.We didnt' think we really needed to check it out considering they had been friends for like 7 or 8 years. I know i wouldn't have questioned any of my friends if id known them that long. Im the one who drove the car, and I don't know alot about cars so thats why I didn't notice things wrong w/it. plus he only let us drive it for like a block! pauls81sc

Onimacus,

There is a big difference between buying a car "as is" and him lying about what kind of engine is in it.

Furthermore, if you agreed on a specific price that included the amp and then he removed it then that is "breach of contract" and is also grounds for voiding the contract.

One more question:
Are you over 18? The reason I ask is that minors are not legally allowed to enter into contracts for anything. If you are under 18 at the time of the contract and you went to court over this chances are the judge would force him to take the car back and return your car and money. I recall from my business law class that the judicial system is very protective of minors and really frowns upon adults contracting with minors.

Whether or not he has signed over the title to you is an interesting matter. If he hasn't then he could try to get the car repo'd but I expect he would have to pay to get it done (probably still worth his while.) If he did sign it over, you have a legally binding verbal contract and are obliged to pay. Although him committing fraud may override your obligation. This starts to get sticky and I'm not really sure how the outcome would be.

In my opinion, dont just get the amp and be satisifed. Offer to negotiate a price based on the value of the car with the ZC engine. If he refuses to negotiate be prepared to get legal. And if you go to see him, dont take the car with you, have a friend go with you and get a ride. You should probably contact an attorney before you talk to this guy again. A call should be free and the attorney should tell you what kind of case you may or may not have. Also, when you tell the guy you have already talked to an attorney that may stir him up too.

GOOD LUCK, (and keep us posted.)
Paul
