2004 X5 4.4 -REAR HATCH problem

Has anyone had a problem with the soft touch rear hatch?
I was driving my new 4.4 off the lot when the trunk open alert cam on. Apparently the rear hatch mechanism has failed and will neither open or close now. The dealer says they can fix it by replacing the locking mechanism.
