2004 X5 Tranny Defect

We, too, need a new transmission after only 2600 miles on a 2004 X5 3.0. In addition to wringing some Bravarian neck, I'd like to wring some concessions from BMWNA. Has anyone tried to get a new vehicle on this problem or obtained any other concessions?

wring some GM necks. the trans is a hydramatic. GM calls it a 5L40e.

As of this week there is a software update to repair the delayed engagement.

I have a new 4.8 and the tranny (auto, 5 speed) is the absolute worst transimission I have ever experienced. It shifts down when it shouldn't, shifts up too quick and bogs the car constantly. I can't believe BMW ever agreed to use this piece of junk!

(sorry, the tranny is a 6 speed auto, not a 5 speed)
