99 Tahoe rear hatch leak

My rear window hatch leaks from the top gasket I guess. I installed a new one but it folds under when it's closed and it's a hassle to get it back out. It is the tailgate model old body style. Anyone have this problem? I replaced the oem padding under the carpet once already. HELP!
