Lambocars copyright threat!

Hey guys!
I appreciate getting to see each and every personally owned Diablo here. Every one of them is absolutely unique, and beautiful in it’s own right. Personally, I own a Boxster (Yeah, I know – boring, huh? HAHAH), but I do admire, as do many others that I know, the sleek and sensual lines of Gandini’s Diablo.
Living in the US, there are many specialty Diablos that we never get the opportunity to see, like the SE30 Jota’s (not street legal here). Since I can’t jump a plane to Europe to take a few snap shots, I occasionally post some pictures that someone else took of a rare Diablo (although not one that is legitimately copyrighted) on my website.
I don’t know how many of you frequent lambocars.com, but I find it in extreme bad taste for the Webmaster there to threaten each and every visitor to his site with copyright infringement for anyone who decides to use any of his 4000 photos. Many hundreds (if not thousands) of these photos, were taken by people just like you guys, but are not accredited with the initial photographers name. Yet, he still proclaims sole copyright of each and every one of these photos.
Example… The picture bellow was on a calendar I owned a few years ago…
I’m a simple Lamborghini enthusiast, and some day, I may be a Diablo owner (like my father – he has a 1996 SV). I think the kind of fraudulent rhetoric that Mr. Smeyers threatens his visitors with diminishes the validity of what the true Diablo enthusiast stands for. Is it just me, or does anyone else think lambocars.com does not have the right to copyright every Diablo picture he posts on his site?

I agree with you mate. I think if you dont take the picture you don't have the right to put your watermark or any copyright action on it at all. Lambocars is an extensive site but you feel as if you are only allowed to look but no touch. Here's an example, if you goto www.lamborghini.ca, you will see a load of Diablo 6.0 images, now Mr Smeyers has his stupid copyright notice on these images but if you look at the Lamborghini Canada site it says:

Re: Marks copyright stipulation. He is placing demands on his visitors (with threats of $150,000. fines per picture), that he does not follow himself. I find it highly unlikely that Mark personally knows who took the picture in my previous post, much less contacted him or her or the hundreds of other photographers who’s pictures are on his site (including his new CD that he is profiting from), to get legitimate copyright permission to display each and every one of the 4000 photos on his website.
In another recent email from Mr. Smeyers to me, he admits to using pictures without the photographers written consent. He stated, “There are scans on my website, and many other for that matter, that are online without the original creator being mentioned, or credited in the caption, as long as the owner of that specific photograph doesn't have a problem with that fact, neither do I…” By his own definition, he is breaking his own copyright stipulation!
I’ve had several e-mail’s (and I wholeheartedly concur), calling Mr. Smeyer’s copyright stipulation invalid - dissuasive scare tactics to monopolize every Lamborghini picture on the Internet unless one personally photographs one. I realize that he has actually photographed some pictures himself, and he does accredit some other photographer’s pictures. But, there is a large number of photos with no credit given, yet he is directing his copyright stipulation to “ALL” of them just the same without “including a link to the original site where many of these photos can be found”.
This is very confusing for a would-be Lamborghini fan considering a Lambo site. Every picture on the Internet is also on lambocars.com.
I have nothing personally against Mr. Smeyers, but I am a web designer with an interest in hosting another new Lamborghini site, and I intend to get to the bottom of this. The attempted monopolization of various interests on the Internet that threatens to snuff out other web designers like myself has been bothering me for quite some time, and I feel like it’s about time someone addressed this issue.
I was even going to send Mr. Smeyers some photographs for his new book of the Truit Cathy (founder of Chik-fil-a) Countach, but I don’t want my photos stamped with copyright threats, or cluttered with that darned “lambocars.com” logo. In my opinion, pictures of cars should be free to copy and post. Otherwise the true meaning of the true super car enthusiast gets lost in dollar signs.
Simply put, Mr. Smeyers needs to rewrite his copyright stipulation. At the very least, he needs to mark the pictures on his site that are actually copyrighted, and the one’s that are merely scanned from a book, magazine, are snatched off someone else’s website. It gets damned confusing when one finds a few great photos on the Internet only to find out that he has them too. His copyright stipulation claims to cover everything “Lamborghini” and this is intimidating, inaccurate, and it discourages others from expressing their infatuation with the Lamborghini product on the Internet.
In another recent email response from Mr. Smeyers, he informed me, “Do note however, that some owners will let you take a photo of their car, but won't allow you to show it on the Internet or publish it in a book or a magazine. When the owner of that car issues this statement, it will be an infraction of his personal rights when someone does publish it, and this publisher can be sued for his publication.”
I’m no lawyer, but personally, I find it preposterous to believe that the law allows the paparazzi to chase down, harass, photograph, and publish pictures of people like Brad Pit, and Steven Tyler, but they would throw you in jail for photographing and placing pictures of their cars on the internet.
And by the way Mr. Smeyers, in response to your remark about 'copying being the sincerest form of flattery', I do NOT want to copy you, I just need some Diablo photos, but since every single Diablo photo on the Internet (according to your copyright stipulation) seems to either belong to you or some “respective owner”, and with the threat of $150,000.00 in fines per photograph looming over my head, I wouldn’t have much of a Diablo website without any photos, now would I?

I agree wholeheartedly!!!!!!! Mark Smeyers don't get me wrong LamboCars is a class site, in fact it is the forefront on Lamborghini. That seems to be the problem though, many people especially Lamborghini enthusiasts want to create a Lamborghini dedicated site. The one problem they have is finding images. Your site is one of the best for these images but everyone has a watermark, thus being your logo. Now correct me if I'm wrong but isn't this just a way to keep this image on your site only and to promote at the same time?

That’s great that you are going to build your own Lambo site, digital_oxygen! I hate it that I waited too long to register diabloworld.com, but I’ll find something else.
I just found something interesting. I’m looking at the December 2001 issue of “Car and Driver” magazine featuring the Lamborghini Murcielago, and they run these little features throughout the magazine called “Reader Sightings”. They are photographs of Porsches, Ferraris, Lamborghini’s, etc., taken randomly by readers.
The one I’m looking at right now is of a new yellow Ferrari Modena parked at a hotel in Ontario, Canada. I can even see the guys tag number – “NOT RED”. No permission was given – nothing signed, just a randomly snapped photo of some anonymous guys (or gals), car.
I doubt seriously that “Car and Driver” magazine would encourage their readers to take photographs of people’s cars if it were against the law. Hahaha :sun:

Mr. Smeyers is a cute bully ( if there is such a thing )... but he must be getting his advice from a chimp about the law and how it works with copyright.
I am a professional photographer and the millions of copies of photos on the web can not be claimed simply buy a bully with enough SW power to plaster his name on every photo he can get his greety hands on. Mr Smeyers you are a first class Jerk!
Take credit for the photos you took with a camera, not the ones you steal from the public domain.
Guys like Smeyers are what's wrong with this world!

At first, I honestly thought that Mr. Smeyers’ was an honest Lamborghini enthusiast, and was either confused, or mistaken about the legitimacy of his copyright stipulation, but due to his lack of input to the above posts, the fact that he has STILL not made an attempt to legitimize his copyright stipulation, and is making money off of the 4000+ photos on his sight (i.e., a CD set, and a book), I simply don’t give him credibility at all.
He has done a wonderful job of avoiding this issue like the plague, so I must assume he has his own lucrative agenda, and would just as soon all of this would go away, but it won’t. Any unwarranted threat (such as Lambocars.com’s copyright stipulation), deserves to be investigated. I have been extremely busy lately, but I will notify the appropriate Internet authorities both here in the U.S., and the Netherlands to correct this wrong since Mr.’ Smeyers obviously has no intention to.

I've just taken a look at all the posts in this thread for the first time, sorry about this, but I'm also rather busy both at work and trying to keep the site up and running.
Note that the copyright and the disclaimer have been rewritten to better display what I actually mean by it.
I don't pretend to have taken all of the photo's on this site myself, only the ones with my name on them, the others were sent to me by guys like you, and they do mention the name of the original photographer.
Just like you all noticed, it's next to impossible to take a photo of each Lamborghini ever made, I also search the web day and night to find rare photo's, but I've been hit by the copyright law several times too, that's why I created the copyright page on my website, and I did get help from a well know authority on internet law and copyright infractions.
Most people think they can get away with the 'fair use' section in this law, but it doesn't apply most of the time unfortunately, as I also noted the hard way, trust me.
Another topic, the CD has never been released, and never will be by the way, so I don't make money from the site, the book is not being published by me, so other than an initial payment from the publisher for the writing of the texts and composing the layout, there is absolutely no gain whatsoever, you might not believe it, but I have only spend money on this site, I haven't made any yet.
I only intended to spread the Lamborghini legacy all over the world, and I do have permission for all of the recent photo's published, all others are in the process of being removed from the site.
I'm really sorry if I offended anyone with the copyright statement, I also received several mails about it, so I've been constantly modifying it, and still will to some extend.
I hope you guys can see my side of this issue too, people have been using photo's taken by me that took a lot of effort and costly travels to take, without even mentioning a name or a source, as most people, I don't like this and would appreciate some respect for the constant efforts this takes.
To finish, I'm removing the Affiliate section from the site and will include something like it's free to use the photo's found on the Lamborghini Cars website when you do mention the source and original photographer, this I think is a more decent way to put things I must admit you were right on that one, sorry about that.

Just like you all noticed, it's next to impossible to take a photo of each Lamborghini ever made, I also search the web day and night to find rare photo's, but I've been hit by the copyright law several times too, that's why I created the copyright page on my website, and I did get help from a well know authority on internet law and copyright infractions.
Most people think they can get away with the 'fair use' section in this law, but it doesn't apply most of the time unfortunately, as I also noted the hard way, trust me.
Another topic, the CD has never been released, and never will be by the way, so I don't make money from the site, the book is not being published by me, so other than an initial payment from the publisher for the writing of the texts and composing the layout, there is absolutely no gain whatsoever, you might not believe it, but I have only spend money on this site, I haven't made any yet.
I only intended to spread the Lamborghini legacy all over the world, and I do have permission for all of the recent photo's published, all others are in the process of being removed from the site.
I'm really sorry if I offended anyone with the copyright statement, I also received several mails about it, so I've been constantly modifying it, and still will to some extend.
I hope you guys can see my side of this issue too, people have been using photo's taken by me that took a lot of effort and costly travels to take, without even mentioning a name or a source, as most people, I don't like this and would appreciate some respect for the constant efforts this takes.
To finish, I'm removing the Affiliate section from the site and will include something like it's free to use the photo's found on the Lamborghini Cars website when you do mention the source and original photographer, this I think is a more decent way to put things I must admit you were right on that one, sorry about that.

Well, I'm off to the "Atlanta Journal/Constitution's 20th Annual International Auto Show"! Man, that's a mouth full.
There will be Diablos as well as a Murcielago on display there. Ferrari's, Porches. and several protypes both foriegn and domestic. I have the digital camera all charged up, and I'm outa here!
