y21 tranny problem

My tranny shifts into 5th gear kinda rough, but it only seems to do it when i am accelerating out of 4th gear and its not doing it all the time. I dont think its the synchro since it would more than likely grind into 2nd or 3rd gears according to my mechanic who did my swap for me. What could be the problem??
