2003 TL Type S - Tranny Problems too ??

Looking at a 2003 Type S (no Nav), and wondering about tranny problems ?? Read the other postings, and no mention of the 2003 model year. Did they fix it for 2003 ? Have a 99' TL now, and love it. No problems really. Any help or advice on the above is appreciated. Thx.

I have a 2002 Type S which has now forgotten that it has a third gear. I have driven it for almost two years without a problem and last night it happened. Shifting from 2nd to 3rd, it just wouldn't find the gear and rev. I then tried to go to 4th, but it wouldn't go there either. At that point, I switch to normal automatic mode and continued to have the problem. The the check engine light went off, the "D5" light started blinking, as well as several other warning lights.

I own a 2003 Type-S, it's got less than 10k on it. Nice car but the transmission shifts a bit sluggish. What I find most annoying, however, is that it hesitates when I'm trying to keep a constant speed in city traffic. Does it especially going uphill every single day. It seems the tranny can't decide which gear to shift into (between 4th and 5th). Feels like the engine wants to cut out or I'm running out of gas (I always use premium-91 octane gas).
The dealership had my car now twice in for several days of test driving with a lap-top hooked up to try to find the problem but they say they can't duplicate it. After the first time the main computer module was exchanged hoping this would help. Didn't do anything. The dealership itself admits that there is an apparent widespread problem with Acura transmissions.
I'm getting really frustrated over this. Considering buying another car if this doesn't get solved.
