Well it finally happened, I was arrested and ive pretty much lost my lisence. As of now i cant drive any motor vehicle(car,snowmobile or atv) i cant be in the shotgun seat, i cant leave central ontario, i cant talk with my buddy that was arrested with me. I have to follow these rules until my court dates which are dec 4 and the 16th. I have been charged with mischife and careless driving while my buddy who was with me driving a bmw, dragged a cop for 100 feet with the car and hes being charged with, assault with a deadly weopon and careless driving. This all resulted because of me doing a harmless smokeshow :mad: So on dec 4 i go for the mischife charge from making a mess of the road which is unfair considering the mark i left. u can barely see it!!!http://files.automotiveforums.com/gallery/watermark.php?file=/503/41132P1000459-med.JPG

and on december 16 i go for the careless driving charge which will decide if i lose my liscence for at least 1 year :uhoh: Honeslty I think this whole deal is being blown WAY outta proportion, i was not involved with the dragging of the cop at all and there was no need for me to be cuffed and thrown in the police van. For doing a burnout!!! tell me that isnt fair :banghead: F*cking COPS!!!!!

he had a hold of the door frame on my buddys car and his legs were on like either side of the rear wheel at first then he had moved them to the side. If the guy was smart he would of let go

Now, now… If they did that they couldn’t be out there writing up TICKETS, and handing out FINES.
Breaking into cars and such doesn’t make any money for the “state” like tickets do and such… Writing tickets, etc ($536 for expired tag, as an example) makes the “state” money. Speeding tickets are EASY money also. Especially to those that are from another state. They figure you’ll just pay the money instead of showing up for court.
Got to love those cameras they’re putting up everywhere. Now that’s real easy money for the state… They mail you the ticket.

IIght obviously i didnt tell u guys the rest of the story lol. This cop was off duty at the time and was not in uniform at all. Here ill just give you guys my staement to read...
On the afternoon of October 28th 2003, at approximately 2:30, my friends and I were out driving.(Josh McDonald and Matt Bray as passengers in my vehicle, and Matt Palmer and Mitchell Sheaves as passengers in Jeff Webbers BMW). We stopped at the side of the road near the intersection. We had been there for around 5 minutes. I was spinning the tires with my car, when we noticed an older man running down the road quite a ways away heading towards us. I kept on with the spinning, and suddenly Jeff and his friends run for his car saying we should leave fast, because it looked as if the man had a phone in his hand. Josh and Matt got into my car which is positioned on the correct side of the road in the correct direction. I put the car in reverse and drove backwards to the nearest driveway, not knowing what was happening with Jeff. As I got turned around and started driving East on the road, I watched in the rear view mirror as this man was running beside Jeff’s car while it is moving. The man leapt at the car and grabbed onto the door frame. The window was down. The last thing I saw was Jeff stopping the car and the man making motions toward the car. After that I was too far away to see any more. I drove around the concession and returned to the spot where I had left. I saw that the man had Jeff standing behind his car. I stopped my car behind Jeff’s, turned it off and got out. The man stood there staring at me looking VERY mad. He finally said “how are you today?”, I responded saying “Fine, How are you?” He said “I’m a police officer, sit on your car and don’t move”. Jeff and I waited there for about 15 minutes until the police showed up. While we were waiting I noticed that Jeff’s windshield was all smashed and spider webbed. Finally one police car came up and parked on the road across from us. We waited as the off-duty police officer told the on-duty officer what had happened. Just after they had finished talking a police van and another cruiser arrived, and right after that an unmarked car came up and stopped. The officers all talked for about 5-10 minutes, finally the officer from the unmarked car came up to Jeff and said angrily “You’re in a lot of f**king trouble, you know that?”, Jeff replied with “Yes sir”. The officer said to Jeff “You’re being arrested for assault with a deadly weapon to a police officer and dangerous driving”. The officer took Jeff around to the back of the van and searched him then put him in hand-cuffs and into the back of the van. 5 minutes later the same officer came up to me and said to follow him. He took me around to the side of the van and on the way said to one of the other cops, “Where is the other idiot” referring to Jeff. He then said “Put your hands behind your back, you’re under arrest for mischief and careless driving”. He then puts handcuffs on me and pushed me into the van. We sat in the van for about 15-20 minutes before we were taken to the Wasaga Beach police department, where we were put in two separate cells and had to wait about 2 hours for our parents to come pick us up and straighten things up with the charges and the contract that I had to sign. When this was all said and done, I returned home at approximately 6:30.

you guys need to go get a lawyer. While I don't live in Canada, here some off duty cop running after your car and grabing it and being dragged would not be assulting a police officer. First of all he is off duty, second you have no idea he is a police officer. He could me some mass murder chasing you to kill you. That would be my defense if I went to court. And how can you lose you license for buring rubber on the street. What exactly are they charging you with. Anyway, you should look at getting an attorney as soon as possible. If the cops did not follow corret procedure or if the miss handled anything then a good attorney can get you out of the trouble you are in.

ok, im a pre law student, and while i dont know canadian law i do know that under most circumstances canadian law is more lenient then their counterparts in the u.s.
That cop was a civilian at the time he pulled his jump in the window escapade. u coulda kicked the shit outta him and gotten off fine. unless he is in uniform he has no legal authority to make arrest, issue a summons, etc.
As long as he didnt identify himself u dont have to worry about the assualting a police officer bs. if he did, u mite have some problems.
as for that dont talk to eachother thing. i would advise u ALL GET THE SAME LAWYER. one lawyer can help u coordinate ur cases so u can stick it up this douche bag cops asshole. thats really the key, stick together and u guys will be alrite.

Do not get the same attorney, you each need your own attorney that prevents the conflict of interest the attorney might face when defending you both. Also, there is the problem of attorney client privilege that could be gotten around by having a third party in th eroom when confidential informations is disscussed.

i asked my dad and my uncle about your story and let both of them read it. my dad is a judge and my uncle is a police officer. my dad said that the off duty was a police officer and if he was the judge in the case you would get a fine.

im kinda interested too see how this whole thing turns out. but i dont see how they could charge you with much being that all you are guilty of is spinning your tires, and as far as the other guy is concerned he could just say he thought he was getting car jacked. But on the other hand, it is cuz of kids like you that the rest of us driving hondas get pulled over all the time and harassed by police.

well what ended up happning is i got off with an unsafe start from stop for a totall fine of 110 bucks and 2 demerit points. and my buddy got off totally free. i can honestly thank the lawyers. anyways thats was a year ago in november
