Transmission Shuddering

I have a 2005 Odyssey with the Vtec engine. Seems to shudder about 30-40mph when shifting. I always thought it was the VTEC but now am hearing it maybe the transmission. I have 105k on the van and just had the Honda garage service the transmission for the 2nd time by changing the fluid. The mech said to call Honda as they have a software change for the transmission. Any word on this?

Honda has a new software update as of June 2012 and this seems to have fixed our problem. Honda in stalled for free even at 122k, it takes 15 minutes and does seem to work.
