Question on insurance companies and totaling cars

I live in Va and my car was hit by a deer two years ago and repaired.
The stance was never right and I complained to the body shop about it multiple times but, they just kept telling me they measured it and it was fine.

Well, fast forward to last week, my mechanic looked at it for me and told me there was definitely something up. He referred me to a body shop as he does more engines and general repairs. The body shop found that my front end shifted 1 inch to the drivers side and the passenger side is 1/2 inch lower then the drivers side. They said it is most likely due to the bend lower A arm they found and showed me.

I called the insurance company up to reopen the claim. My questions is, can they look at the price of the repair 2 years ago and combine it with the price of the damage found last week and total the car? If not, can someone point me to the law that states they can not do that?
