Love letter from the finance company.taranaki 01-17-2005, 07:49 PM 6 months ago I got a huge pay rise. :smile: To celebrate, I went out and bought a Skyline.Straight off the lot, no quibbling about the price, no quibbling about the finance terms,an extra 200 dollars a week in my pay packet meant that I could easily afford to be lazy and go with the sales yard's terms rather than shop around for finance.Besides, the car was in pretty good order and I didn't want to see it sold while I arranged to pay for it.So I signed, handed over the deposit and took possession.Very happy. Today,I am not happy at all.I received this letter. PREPOSSESSION NOTICE This is about your 1994 Nissan Skyline,Grey,which is subject to a credit agreement with Assclown* Finance.The agreement is dated 29 July 2004. This is to notify you that *you are in default under that credit agreement,and *the default consists of NON PAYMENT OFINSTALMENTS. YOU MUST, within 15 days after the service of this notice on you, pay $107.85 to Assclown* Finance C/- [address]. That amount is made up as follows: 1 instalment dated 29/12/04 of $107.85 IF YOU DO NOT COMPLY with these requirements within 15 days after the service of this notice on you,Assclown* Finance INTENDS TO TAKE POSSESSION of the Nissan Skyline,Grey. Dated 13/01/2005. :screwy: :screwy: :screwy: :screwy: :screwy: : to further support their claim, they included a printout of their records,a portion of which I have scanned and posted for your amusement. http://img.photobucket.com/albums/v11/taranaki/assclownfinance.jpg As you can see, 1.They're demanding the wrong amount 2.They're claiming that payment was missed on the wrong date 3. A payment has been made since the alleged default. So......WHERE THE FUCK DO THEY GET OFF ON THREATENING TO REPOSSESS MY CAR? ....Well, if you look at the log, there is a gap in the records.A payment of $129.38 should have been recorded on the 16th Dec.It was taken from my bank, but apparently ,Assclown* Finance stuffed up. I made a phone call to the bank, then a call to the finance company.within 10 minutes, I got a call back acknowledging that I was in fact up to date with my payments,and it was their error. My big beef is this. This ridiculous demand was mailed to me. Had I not cleared my mail within the 15 days,the first I would have known would be a goon in a tow truck turning up on my doorstep. I could have been trying to block a Neanderthal from taking my car over an alleged debt of 100 bucks........less than a half day's pay. I realise that there are people out there who bilk their payments, but my credit record is spotless.Even if I had missed a payment, I would expect to be treated with more common courtesy than this. I now have the added hassle that I have no confidence in the abilities of Assclown* Finance's accounts department.Rather than risk having them turn up and tow my car, I am going to look at refinancing through a more competent institution.My bank has already expressed an interest in refinancing on my behalf.Even if it ends up costing me a few extra dollars, the peace of mind will be worth it.Two years is a long time to be in the hands of morons who can't even read their own paperwork. Those of you who visit the political forum may feel free to imagine the conversation I just had with the car yard. Until this morning, they were more or less guaranteeed my repeat business. About a year ago i bought some software online and when it didnt work properly i emailed the company asking for my money back stating the i deleted the product and it didnt work. I got the run around for 2 months and was then told that the refund period was over and that i could no longer get my money back because i took to long. If I went through a 3rd party company, I would end up paying over 3 grand just in fucking interest, and heaps tax, fuck that. It shows that they don't have much respect for themselves and if you don't respect yourself, you won't respect your customers. Just kidding... But seriously...If they sent you a repo notice there is no telling what they may have reported to the credit bureaus. You may have a flag on your credit report which will haunt you for 7 years or longer. My suggestion would be to get a copy of your credit report and make sure they didn't report late payments or a default. If they did, get on the phone now and make sure they change it. Messed up credit is hard to recover from and waiting to fix an error makes it harder to get it fixed. You can get a free copy of your credit report through yahoo. Pretty much the only reason you should ever deal with one is if you have a shit credit history, or not enough income, thus u can still get finance but be paying up to 30% interest :rolleyes: re-finance it with your bank, using a personal loan so the car isn't used as security, you will most likely save money in the long run ( the ineterst rate on the personal loan with a tertiary package at NBNZ is 9%, but u will probably get a better deal if you are a long-standing customer of your bank) also you might want to save a couple of those "quiet words" for when assclown finance tells you theres a big fuckoff fee for paying it off before the 2 years run out (which is obviously whats gonna happen if you re-finance it with someone else) Limited5.9Cherokee 01-18-2005, 12:14 PM OK enough car salesman slamming..... bad finance companies is no reason to slam the salesman. that is pretty crappy. i know companies that purposely send out past due notices so people pay them with no question. the few that do contest them, they fix but the %80+ that just pay their bills, just get ripped off. cell phone companies are the worst about it taranaki 01-18-2005, 02:52 PM OK enough car salesman slamming..... bad finance companies is no reason to slam the salesman. When I worked for the car shipping we did repos too. They suck and feel bad for the owners. One owner had the papers to prove that he paid the bills and the company messed up but i still needed to take the car. Very few that I personally did was owner's fault.
