Overdrive light on at startup

Upon startup, overdrive light comes on, meaning overdrive is off. If I continue
it's as if my emergency brake is on--engine seems to be under stress.
If I turn off the engine and restart then overdrive light goes off meaning
overdrive is activated then all is well. Two analysis say I must replace
the transmission! Big bucks. This overdrive light problem does not
always happen. The most often it happens is sometimes at the first
startup in the morning but not even then all the time. I don't think
it's happened anytime during the day at startup. Any thoughts, I
don't want to spend any unnecessary dollars. Also, if I try to push
the button to activate or de-activate overdrive, it does nothing.
