When I removed my snow tires at the end of last season, one tire was damaged. The others, Kumho Izen Suds had one season on them. So, this weekend I bought a new Izen and mounted them with the others. Tread depth on old tires 9.5/32" and 13/32" on the new one. What is the opinion on risk of transmission and transfer case damage due to this difference. Subaru says no more than 2/32" difference to avoid problems. Any real life experience/advice?

You should always AT LEAST replace tyres in pairs, the uneven wear and grip of the tyres can cause problems, even on a FWD at times.
You'd be better off getting the opposite side tyre replaced too and perhaps put the worn one on a full ize spare for the winter months.
