Need help from getting compensation from Walmart

I had engine oil change in Walmart right before I had a long trip. The next day I had to drive from Oklahoma to Texas. After I had driven for about 1000 miles(within five days,) my engine died on the way back to Oklahoma in the middle of nowhere at night. The next day, a mechanic found the engine oil was 2 qt more than it should be (my car's capacity is about 4qt.) I had no choice and was forced to change my engine for about $2k in order to get back home. Now I am trying to find compensation from Walmart.

I gave the report from the mechanic and receipts to Walmart. They filed my claim to their insurance company (Claims Management, Inc.) The insurance guy called me and left a voice msg. I called back many times and also left a voice msg, but he didn't call back again.

I had my Ford 97 Escort for about 6 years. No other problem nor accident had ever happened to my car like this. I am really having a hard time now because I don't have a full-time job. Now the car damage made my life so much worse than before. What I am wondering is: Is there another way to do to get compensation from Walmart? Any opinion would help. I really don't know what else to do now. Thank you.

Your insurance company may be able to process a claim on your behalf. Give them a call and see what they say.

If you don't have any luck there, you can always hire an attorney. But it may end up costing you more in legal fees than you already paid. The other option is to head over to small claims court and file what's called a "pro-se" claim, which is an action against another party in which you are representing yourself. That might be the best way to proceed.

I filed a pro-se action against a transmission shop and won my case in a matter of months. I also had him closed down and tagged with a civil nuisance action on my behalf by the NYS Attorney Generals office. So, you never know. Only costs a few dollars to file a claim, and once you get that paper trail started, someone has to be accountable for it in the end.

The last four times, we had problems with local cheap oil changes.
1) Checked oil and was shorted.
2) 1/2 quart too much.
3) Stripped oil drain plug.
4) Tighten oil drain plug too tight.

Need dates, receipts, store #, 2nd opinion on cause, and a hungry Attorney.
