Re: What is happening with Zero paint?

Hi Guys

It seems that I'm in the sights the lawyers this week. hummmmmm
Many letters (Red Ball, Lambrogina, Jagermestar, F0rd and Pocrshe) have arrived stating that we need to stop producing paints with manufactures names in them e.g. Jagermeistar Orange (spelt wrong I know to stop google indexing this)

Which it would appear is confusing customers , thinking it is an official product, we can NOT use the name "Jagermeistar" anywhere in the description of the product as it is profiting from the use of a trademarked name.

I feel this is bullsh*t but need to find a legal solution to the problem before we continue to sell them.

I know many places like Half∞rds (UK) sell Porsche- Cobalt Blue touch up paints, which I'm being told is technically wrong and infringes trademark and copyrights.

I'm sure many of you will have opinions on the subject, but until I get legal conclusion they will not be listed as before.
Custom Paint mixing is now the same price as standard 60ml bottles.
please quote the make and code etc at the checkout in the comments box.

Phew I think this has covered it for now. I'm off on a few days rest over the bank holiday.........Then think more..

BTW we can not sell the E.Jan RB5 kits as we have been targeted about this license infringement as well, so with retreat it seems we will need to refund all pre-orders.
If you want to contact me about any of this please email support@hiroboy.com only do not PM as I don't accept them any longer due to time restrictions etc.

Re: What is happening with Zero paint?

Unbelievable!!!
These idiots are don 't understand that when we built and presented a model, (in a website or to an expo) with their liveries, we made advertisement to their companies...
In this way, I think companies must leave trademarks free, to the models and hobbies.
Steve good patience with this complicated situation.

Re: What is happening with Zero paint?

This maybe a stupid question, but when ordering the paint, where it says paint code. Does he need the factory paint code or like a PPG code.

Thanks

Re: What is happening with Zero Paint?

We need the Car/Bike Manufactures Factory Code only
PPG Code is NO good for mixing Non PPG paints as the numbers do not cross reference.
Our paint is supplied by Lechler, you can check paint formulas online at http://explorer.lechler.it/ (It can be slow) we use a local DVD version

And the names of brands and sponsors will not be on paints?

Re: What is happening with Zero paint?

Given the ludicrous claim that customers are confused about the brand labelling, and that we're stupid enough to believe they are the 'official' paints, maybe it would be wise NOT to say 'As used on Ferrari cars'? Some lawyer or other might see that as an opportunuity to write another letter to you informing you that Zero Paints actually aren't used on Ferrari cars.....
An alternative might be 'Same colour as used on Ferrari cars'.

Anyway, this can wait - you've got an order of mine that needs to be packed & dispatched!

Re: What is happening with Zero paint?

Sorry to take this marginally off-topic, but seeing as we're talking about Zero Paints and we have your ear Steve, would it be possible to supply all your paint in a choice of both 30ml & 60ml jars?
I know you're being conservative when you say 60ml should be enough for two 1/24 car bodies but my experience is that a 60ml jar will cover WAY more than that, and quite frankly is often WAY too much for my needs.
If all paints were also available in 30ml jars I'd be able to buy a greater selection of those lovely lovely colours.....

Jon.

Steve good patience with this complicated situation.
This could be a reason why many manufacturers are less inclined to release new models from these particular models, ie Ford. How many model manufacturers actually have a proper Ford model these days? I know Renaissance has the Focus WRC in resin, but as for licensing issues, that is a whole different story. Imagine this, they used to bug us modelers duplicating parts, and now, PAINT? I do feel that boycotting them might be the only solution. They are getting a little too over their heads with this bl**dy licensing already. If it wasn't for these licensing issues, I bet that most manufacturers will be more than willing to release more new cars a year. But then again, factors like the numbers of modelers etc are also important. We modelers are not many, really.

Enough with that, I do hope Steve manages to pull through this smoothly. Good luck mate !

Re: What is happening with Zero paint?

Will you still be able to mix the non manufacturer colours such as the specific ones for F1 cars..??? (J*rd*n 191 greens, M*L*ren MP Red etc) It would be a shame to see those disappear from the store.
