Still fighting over my wreck but progress

Here is the poll: If you were buying a used car, and you found out that it was in an accident - would you pay fair market value?


Ok - as some of you know I got rearended 1 week after buying my brand spankin new G20...... I finally get the repairs done in about three weeks - I noticed that the paint from the factory has a flaw (discolored) on the spoiler, and a large run in the paint on the trunk lid, and finally dirt in the paint by the license plate - mind you this is from the factory, no repairs have been made yet. Should I call the dealer and try to get them to pay to have this fixed while I'm there?

Also - Diminished value claims are allowed but I have to prove my case. My argument to the guy's insurance was that if anyone runs a carfax they'll see an accident report, no problem titles or anything, but an accident report. Thus if 5 years down the road I goto sell my car and someone runs this report it will not be easy to get fair market value out of my car. (I know, I won't really sell it, but just in theory) Next question - any ideas to help me prove my case? I had to fight and fight for them to even admit that they'd be willing to settle with me over it. I think I may goto some expensive car dealerships, tell them I want to trade it in, ask what they'll give me, and then explain the wreck (rearended by a pickup at 20-30mph while I was stopped doesn't sound good in ANY kind of car) Anyways maybe do that and print some lit. off of carfax....
Any more ideas? I'm just trying to get my fair share out of all this.... I've put on an extra 300 miles between body shops, dealer visits ect because of the wreck plus got rock chips on the way to these places so damnit I'm entilted to something! lol...

That 'dirt' is probably just rail dust. A clay bar will get that out...although the dealers should have taken it out for ya. Not that it really matters now.

accident

anyone who does a carfax report on you will use the accident to undercut your asking price.
honestly i would stay away from the car if i had a choice between an accident and a non accident.
realistically, it's very hard to find a five year old pristine car.

i say go to the dealerships and get a paper quote on how much they would offer you for your damaged car vs one from a non damaged one.

More info - apparently all states allow for a diminished value claim and there are places that specialize in proving your case for a fee, in my case $250 - the guy says I'll get a few G's for it easy.... woo hoo now other info - You get more based on how new the car was (7 days off the lot is pretty damn new), and if it is a luxury brand or not (go infiniti!) So basically I've got a damn good case - He also told me that notifing the insurance before the repairs are made about the claim makes things better - they will pay top dollar for the repairs so that less can be found when this guy investigates the car - plus they know that I know what the hell is going on..... It was a very good day in terms of progress, I would still rather have a non-wrecked car than the money but hey I'll take what I can get....

We'll see.

Pissed that the first State Farm rep lied and told me that there is a law in Ohio that keeps you from filing a diminshed value claim.... Might come in handy though hehe....
