325i DINAN EXPLODES

I had a 2001 325i which I had Momentum BMW of Houston install DINAN engine and transmission software, as well as exhaust and suspension.
In June of 05, I hit a tire which destroyed many engine components such as the radiator and subsequently OVERHEATED. The car was repaired by a general purpose mechanic (not Momentum) as the incident happened out of town. All repairs had to be authorized by State Farm. The car was "repaired" and driven for 6 weeks.

In August of 05 the engine flew apart when I was driving at 45 mph on a straight line. The car was then taken to Momentum BMW where the service advisor stated that prior engine damage was the reason for the car's failure.

State Farm is stating that this is not the case and is pointing to other scenarios including the fact that the car was a "Dinan" and that my driving record "(1 speeding ticket) were factors in the engine's demise.
