Ignition switch problem

Anyone else have their car not starting in cold weather? Turns out the ignition switch had a gel in it that freezes so they replaced it with one that doesn't freeze. seems like a factory defect to me. I was out of warranty on my 03 ion and it wasn't covered. anyone have any ammo to argue it should have been a recall and covered?
