Its illegal cause its considered Noise pollution, and you're bybassing the cat and muffler. Thus you're letting out pure smog into the air... not that big of a deal for one car to do it. But if everybody did it there'd be a problem. The gains of using it is you'll gain a considerable amount of top end pull from your motor... but you'll loose down low torque. Depends... depends on how far from the engine the cut out is, and what type of motor, what's done to it.
